Heather Mills has been seen holding a notebook detailing her divorce plans. The former model, the estranged wife of Sir Paul McCartney, was photographed at London's Victoria train station on Tuesday holding hand written notes which suggest she wants to fight Paul for occupancy of their matrimonial home. In the notebook, Heather had written: "I'm seeking an order for occupation of the matrimonial home. "It is unclear whether the notes refer to the couple's property in North London, East Sussex or the Hove property where Heather is currently living.The Peasmarsh estate near Rye, in East Sussex, has been Paul's family home for almost 40 years. The house was a wedding present from The Beatles legend to his late first wife Linda when they married in 1969. Heather, 38, who was embarrassed to arrive at the couple's North London mansion in August to find the locks had been changed, also wrote that she wants "unlimited access" to the house until the divorce is finalised. Lawyers have said Heather could force Paul out of the property if she can prove her claims of domestic violence. In leaked divorce papers she claims Paul was violent towards her, and also drank and took drugs excessively.Legal experts also suggest that because Heather has lived in the Hove home with the couple's three-year-old daughter Beatrice she has the right to stay there unless a court rules otherwise. Stephen Foster, head of the divorce department at London law firm Stewarts,said: "The matrimonial right to occupation arises not out of ownership of a property, but by virtue of living there. If Heather has lived there with a child, she has a right to remain there unless a court makes an order otherwise."Heather's spokesman said: "We will not discuss private divorce matters."Sir Paul, 64, filed for divorce in July after four years of marriage, citing Heather's "unreasonable behavior".
