NO BID'S FOR ANNA NICOLE SMITH DIARIES

Anna Nicole Smiths death may have sold lots of newspapers and magazines, and are what movies are made of, but her personal diaries refused to sell at auction. Her two personal diaries that most would think were worth big bucks, in Texas on Saturday. The journals, written in the early ’90s, initially had at least two bidders before Smith’s former partner, Howard K. Stern claimed they were stolen and should be returned to her estate. "Make no mistake: these items were stolen from Ms. Smith by one or more thieves," attorney, L. Lin Wood, wrote in a letter to Doug Norwine, the director of music and entertainment memorabilia at Heritage Auction Galleries of Dallas on Wednesday, TMZ.com reported. "Ms. Smith's Estate intends to vigorously pursue the return of the diaries, will take whatever means necessary to secure their return, and will hold to account those persons and entities that have profited through their reprehensible acts at the expense of the Estate." "On behalf of the estate, Mr. Stern hereby requests that the diaries be returned to him immediately," the letter added. TMZ also reported that the man claiming to be original owner of the diaries, denied Wood’s claims, saying that "the facts he mentions in the letter are FALSE -- these diaries are NOT stolen, (They were obtained BEFORE her death) -- he is just trying to steal more money in the name of Anna Nicole." The auction house said yesterday the journals, which contain entries about Smith’s weight problems and issues regarding her personal life, are now available for a minimum bid of $25,000 each. “We have a buy-it-now situation,” said Norwine but added the bidders just “got cold feet” following Stern’s public claim. The auction house reportedly got the journals among other items from an anonymous German businessman who purchased the items on eBay for more than $500,000 several weeks ago. The German businessman decided to auction the diaries after securing the publishing rights, Norwine said. The two personal diaries were supposedly written between 1992 and 1994 and provide details regarding Smith’s feelings for her late husband, oil tycoon J. Howard Marshall II. Along with the journals, the auction house also obtained a $16,954.66 receipt from a Bloomingdale's shopping spree in 1992, a signed bank check from Smith and her 1994 Texas photo ID card. "In the absence of a judge stopping this auction, this auction will go forward," Norwine was quoted by CBS as saying. "After the auction we'll determine what happens. We will continue to take the high road.”

Question : If Larry Birkhead is the father and in charge of the estate, how can Howard K. Stern demand them back ?

LARRY BIRKHEAD AND VIRGIE ARTHUR TRYING TO COME TO A AGREEMENT

A hearing in a Bahamas court on Friday failed to end a prolonged battle over custody of late Playboy Playmate Anna Nicole Smith's daughter, 7-month-old Dannielynn. Larry Birkhead a Los Angeles photographer and former boyfriend of the billionaire's widow, was identified on Tuesday as the father of the baby, who could one day be worth a fortune if Smith's estate wins a decade-long battle to inherit from her former oil tycoon husband J. Howard Marshall. Friday's hearing over custody of Dannielynn, at which Birkhead had been widely expected to be awarded guardianship based on court-ordered DNA tests, adjourned soon after it got under way. Damien Gomez, an attorney for Smith's long-time companion Howard K. Stern, said the hearing was suspended at the request of lawyers for both Birkhead and Smith's mother Virgie Arthur. Gomez did not elaborate. But John O'Quinn, Arthur's lawyer, told reporters Birkhead and his client had agreed to meet privately on Saturday in an apparent bid to reach an agreement over custody of the child. Without any lawyers present, O'Quinn said the father and grandmother of Dannielynn would try "to figure out what they believe is in the best interest of this child and try to get it done." Whatever plan they come up with would then be submitted for court approval, O'Quinn said.

WICKED HOWARD K STERN TO SUE VIRGIE ARTHUR'S LAWYER FOR SLANDER

Howard K. Stern, Anna Nicole Smith's attorney and partner, filed a defamation lawsuit Friday against the lawyer for Smith's mother. The suit, filed in federal court in West Palm Beach, Florida, alleges John O'Quinn, attorney for Virgie Arthur, defamed Stern in statements made on television after the actress' death in February. "The lawsuit focuses on Mr. O'Quinn's recent appearances on a number of national television shows in which he has made public accusations of murder and other misconduct against Mr. Stern in connection with the Anna Nicole Smith case," according to a statement released by Stern attorney L. Lin Wood of Atlanta, Georgia. Wood specifically cited a February 21, 2007, interview from Fort Lauderdale, Florida, for the Fox News show "On the Record with Greta Van Susteren." "As stated in the complaint filed today, Mr. O'Quinn's accusations against Mr. Stern are false and Mr. Stern seeks to hold him accountable through the civil justice system." O'Quinn could not be reached for comment Friday. In the Bahamas on Friday, attorneys in the custody case surrounding Smith's 7-month-old daughter said the judge wants Larry Birkhead -- declared Tuesday to be the child's father -- and Arthur to come up with a plan regarding access to the child. The two were supposed to meet Thursday but did not. The judge told the parties to get together and appear in court next Friday. O'Quinn told CNN's "Larry King Live" earlier this week that Arthur would not seek any sort of guardianship for baby Dannielynn after Birkhead's paternity was revealed. After the custody hearing, Stern said Birkhead has been visiting Dannielynn at Stern's home, where she has been staying since Smith's death. "At least informally, the transition period has already begun," Stern said. "Larry spent the majority of the last days over at the house getting to know Dannielynn. He's been changing diapers, he's been feeding her, he's been playing with her, and if you ask me, he's been doing a great job." Stern, who is listed as the girl's father on her birth certificate, initially was battling Birkhead in court over paternity until DNA results proved the child was fathered by Birkhead. A hearing regarding the formal transfer of custody is scheduled for next Friday. "If it were up to me, the formal order in terms of giving Larry full custody would have occurred today, but unfortunately it didn't," Stern said.

LARRY BIRKHEAD GETS READY FOR FIGHT WITH WILD AND FUN VIRGIE ARTHUR

While photographer Larry Birkhead was officially pronounced the biological father of Anna Nicole Smith's baby Dannielynn, he might face subsequent legal battles over her custody. However, Anna's late partner Howard K. Stern has made clear he will not challenge Birkhead and he's "going to do whatever [he] can to make sure that he (Larry) gets sole custody." TMZ reported that Birkhead took Stern up on his offer to "spend as much time with [Dannielynn] as he wants to right now," logging several quality father-daughter hours at Stern's Bahamian home on Tuesday night.This leaves only Anna's estranged mother Virgie Arthur as the only possible challenger of Birkhead's rightful custody. However, he's not willing to compromise, and she stands slim chances of winning.Virgie Arthur, Smith’s estranged mother, who wanted to bury her in Texas, after Smith suddenly passed away on February 8, filed paperwork last week asking to be named the child's guardian."All I care about and all I ever cared about is the safety and well-being of my little granddaughter, Dannielynn," Arthur said. Anna Nicole Smith’s former boyfriend Larry Birkhead said Tuesday that DNA tests have proven he is the father of her infant daughter. Birkhead emerged from a closed court hearing to announce the results, “I told you so!” Smith’s companion, Howard K. Stern, has been caring for the girl, Dannielynn, who could inherit a fortune in the wake of her mother’s February death. After the hearing, Stern said he would not fight for custody.An expert in genetic evidence said the DNA analysis has proven Birkhead is Dannielynn’s father. Dr. Michael Baird, who analyzed the results of a March 21 DNA test, announced the results outside the court. “Essentially, he’s the biological father,” Baird said. A jubilant Birkhead said “My baby’s going to be coming home pretty soon.” The baby, whose full name is Dannielynn Hope Marshall Stern, could inherit millions from the estate of Smith’s late husband, J. Howard Marshall II. The former model had been fighting the Texas oil tycoon’s family over his estimated $500 million fortune since his death in 1995.

The sleeze man claiming to be the father of Anna-Nicole Smith's daughter has hired a lawyer to end his "trial by media". Howard K Stern, the former Playboy Playmate's partner at the time of her death, feels he has been falsely implicated in her death.He has now retained Lin Wood (right) to represent him in possible legal action against media companies. Stern, himself a lawyer, is one of three men claiming paternity of Dannielynn. Wood has handled a number of high profile cases, including representing the family of slain child beauty queen JonBenet Ramsey. He said: "My representation of Mr Stern will focus on those individuals and entities guilty of making false accusations of criminal conduct against him related to the tragic deaths of Anna Nicole Smith and her son, Daniel. "Mr Stern is an innocent individual who has never been charged with any crime but finds himself on trial in the media. "The nightly television, tabloid and Internet trial of Mr Stern in the court of public opinion based on sensational lies, speculation, rumor and gossip is over." Stern, who lived in the Bahamas with Anna-Nicole, is listed on Dannielynn's birth certificate as her father. But two other men - former boyfriend Larry Birkhead and Frederic Von Anhalt, Zsa Zsa Gabor's husband - also claim to be the father.

AN accidental drug overdose caused last month's sudden death of former Playboy Playmate Anna Nicole Smith, Florida officials said. The death of the flamboyant billionaire's widow at a Florida casino-hotel on February 8 triggered a media frenzy and bitter legal feud over her remains and the custody of her six-month-old daughter, Dannielynn, who could one day inherit millions. "We are convinced, based on an extensive view of the evidence, that this case is an accidental overdose with no other criminal elements present," said Seminole Police Chief Charlie Tiger. There was no evidence of illegal drugs in her body, said Broward County Medical Examiner Joshua Perper, who gave a detailed account of the events leading up to her death that included her temperature at various times and the medication she took. Smith was buried in the Bahamas on March 2 after a colorful funeral whose guests included her long-time companion and lawyer Howard K. Stern, who is listed as Dannielynn's father, and Los Angeles photographer Larry Birkhead, who also claims paternity. Several other men also claimed to be the father of Dannielynn. The results of a DNA swab of the child have been placed under seal by a judge in the Bahamas, pending an appeal against the DNA test by Stern.

HOWARD K. STERN BEING EVICTED SOON

Anna Nicole Smith's longtime Lawyer/companion Howard K. Stern is on the verge of losing the Bahamian home he shared with the tragic model. He recently learned an eviction summons has been requested. Attorney Godfrey Pinder is requesting Nassau officials evict Stern from the Horizons house he has occupied since August. The Bahamian lawyer is acting on the request of his client, developer G. Ben Thompson, who insists he offered his house when Anna Nicole was looking for property in the Bahamas. The request, filed on Wednesday, states Stern has been "trespassing" on Thompson's property since before February 8, 2007 -- the day Smith died. Pinder has told " Access Hollywood ," "I served a summons asking the Magistrate's court to give us an eviction notice against Howard K. Stern and to have him pay rent and legal costs and damages, if there are any damages in the place." Pinder claims Thompson bought the house and had his lawyers draw up the papers for it in Anna Nicole's name -- because she planned to buy it from him. Thompson maintains his friend then declined to sign the mortgage or promissory note. Pinder attempted to serve Stern with the notice at the property on Wednesday, but was forced to leave it at the entry gate.

Stern - who is listed as Dannielynn's father on her birth certificate - was left devastated by the judge's decision. Photographer Larry Birkhead and his attorney have parted company as the latest battle in the snapper's paternity battle over Anna Nicole Smith's child gets underway in the Bahamas. Lawyer Debra Opri has issued a statement this morning, confirming the split, saying, "Larry Birkhead and I have terminated our attorney-client relationship effective immediately." Opri has since spoken to news show "Extra" as part of an interview that aired the other day. She reveals she felt she had to part company with her former client because she didn't agree with Birkhead's apparent friendship with his paternity battle rival Howard K. Stern. Opri tells the TV show, "I just had enough. I can't represent a client who has a middle man by the name of Howard K. Stern. I feel very comfortable in my decision, and I wish Larry the best. But I am worried about him... I couldn't continue with the way things were going." Reports have suggested Birkhead and Stern are close to coming to a financial settlement about the future of the baby both claim is theirs. A Bahamian attorney will represent Birkhead as he fights for custody of baby Dannielynn today in the Bahamas. The photographer has been demanding a DNA test on the baby since late last year after insisting he's the Dannielynn's biological father. Stern, Anna Nicole's longtime companion and lawyer, maintains he's the father, as stated on the baby's birth certificate.

ANNA NICOLE SMITH'S COMPUTER FILES

Police and Broward County, Fla., prosecutors discussed whether they can get search warrants to access Anna Nicole Smith's computer files, it was reported. Seminole tribe police have the computers, but expressed concern about examining them because it wasn't clear whether the computers were legally obtained, the Miami Herald said Thursday. Smith's computers, removed from her home in the Bahamas following her death Feb. 8, may or may not be a part of the investigation into her death, Florida officials said. Bahamian law officials were also talking with Broward prosecutors. Among other things, Bahamian police are investigating whether Smith's computers were removed during a burglary at her Nassau home. Ford Shelley, a friend of Smith's who owned the home where she lived, testified that Smith asked him to care for the computers should anything happen to her. He took them from the Bahamas and later turned them over to police in South Carolina, where he lives. South Carolina police released the equipment to Seminole police. Authorities stressed they have no evidence of foul play, but must follow all possible leads.

JUDGE DENIES LARRY BIRKHEAD IN ANNA NICOLE SMITH PATERNITY CASE

A Los Angeles judge denied a motion by Smith’s former boyfriend asking that Smith’s partner would be forced to immediately give a sample of his DNA for the ongoing paternity case. TMZ.com reported that photographer Larry Birkhead , the late model’s former boyfriend, one of the men who claim to be Smith’s baby’s father, asked a judge to make Howard K. Stern come to California and submit to DNA testing to determine exactly who Dannielynn Stern's father really is. After the hearing, Birkhead’s attorney, Debra Opri said she was confident that Stern, who is listed as the baby’s father in her birth certificate, would be made to come to California. "Put up or shut up, that's what we're asking for," Opri said. She also said Stern "can't hide behind a fake birth certificate" and that his "feet will be held to the fire." However, Los Angeles County Superior Court Judge Robert A. Schnider denied Birkhead’s motion, but left the possibility that he could change his mind later this month, open. He asked instead that both sides would present their arguments during the next hearing which will take place in Los Angeles on March 28. Associated Press reported that Ron Rale, a lawyer who had represented Smith argued against the DNA request, saying Stern's name is already on the birth certificate as the father. "Howard Stern doesn't have to go to Larry Birkhead for anything," Rale said. Birkhead, for his part, said, "I'm just doing what I have to do for my daughter," and that for him, holding Dannielynn for the first time in the Bahamas "was like being in the delivery room." Birkhead said he has made no agreement with Stern about the child. "My daughter is not for sale," he said. "I've been putting a nursery together so I'm smiling," he told reporters. "I'm in a good mood. "There's one way to end it. I'm prepared to take the test. I've always been prepared to take the test. Ever since Anna Nicole Smith gave birth to Dannielynn Hope Marshall Stern in the Bahamas, three days before her son, Daniel, died, Birkhead claimed he was the father, not Stern who is listed in the birth certificate. Initially, Schnider ruled in Birkhead's favor on December 21. Rale has said the judge wanted the testing done by Feb. 21 but the case was stalled when Anna Nicole Smith died of unknown causes on February 8, in a Florida hotel room.

OJ SIMPSON CLAIMS HE COULD BE FATHER OF ANNA NICOLE SMITH'S BABY

O.J. Simpson has allegedly claimed he could be the father of the late Anna Nicole Smith's baby, Dannielynn.The pair starred together in 'Naked Gun 331/3: The Final Insult' in 1994 and O.J. allegedly told documentary maker Norm Pardo - who filmed 70 hours of footage with him from 2000 to 2005 - that he was "throwing his hat into the ring" regarding the paternity battle. Pardo told the New York Post newspaper: "He said he knew Anna Nicole pretty well, and he said he had slow-moving sperm, and he might be the father."O.J. - who was cleared of murdering his wife Nicole Brown Simpson and her lover Ron Goldman - even joked he hoped the baby wasn't his as Fred Goldman - Ron's father who has pursued O.J. for damages in the civil court over his son's murder - might try to take her. Pardo claims O.J. said: "I hope they don't do a DNA test on Anna Nicole's baby. If they find out Dannielynn is mine, I don't want Fred Goldman trying to seize her money - or the baby herself."The five-month-old daughter of Anna Nicole - who was buried in the Bahamason Friday - is currently in the custody of the courts as both Howard K. Stern and photographer Larry Birkhead claim to be her biological father.

ANNA NICOLE SMITH'S MOM CONTINUES WAR

A Bahamian court considered a request to exhume the body of Daniel Smith, son of the late Anna Nicole Smith, for reburial in Texas, where Smith was born. The request was filed by Smith's estranged mother, Virgie Arthur, who reportedly has a letter from the son's father authorizing her to ask the Bahamian courts to order the body be exhumed and buried in Texas, the Bahama Journal said Monday. Arthur tried unsuccessfully to gain custody of Smith's body in a Florida court, then tried to block the funeral in a Bahamian court. She said she wants to bury Smith's body in Texas and has said she wanted to move the body of Smith's son, who died in September, to Texas as well. She filed the exhumation request Friday, the day Smith was buried. Smith died Feb. 8 of unknown causes in a Florida hospital where she was taken after being found unresponsive in her hotel room.

ANNA NICOLE TO BE BURIED TODAY

Anna Nicole Smith is to be buried in the Bahamas today, after her mother dropped her appeal for custody of her body.Virgie Arthur will not challenge the decision made by a Florida appeal court that custody of the model's remains should go to Richard Milstein, the court-appointed guardian of her five-month-old daughter, Dannielynn.Virgie's attorney Tom Pirtle said: "It's going to be difficult to appeal the ruling, so we're not going to appeal."Milstein said Anna Nicole will be buried in the Bahamas next to her son Daniel, who died last September.Virgie had wanted Anna Nicole to be buried near the family home in Texas,and for Daniel's body to be exhumed and buried beside her. Milstein said: "The funeral is set for Friday. I wish to uphold the decorum and dignity that should be maintained throughout this process, for the sake of Dannielynn and the memories she will have of her mother's funeral."Anna Nicole died aged 39 on February 8. Her body has remained in cold storage at a Florida morgue during the court battle over where she is to be buried.

John Travolta says Scientology could have saved Anna Nicole Smith.The actor insists the late Playboy Playmate may still be alive if she had checked into the controversial Scientology drug and detox programme Narconon. John, who worked with Anna Nicole on 'Be Cool', said: "It's so sad. We could have helped her with Narconon but didn't get the chance to. I wish we had."Narconon has been widely criticised for its unorthodox methods which are inspired by the teachings of Scientology founder L. Ron Hubbard.The treatment includes taking large doses of vitamins, an intensive running program, and long sauna sessions which "run out" drugs and "radiation"from the body. Scientologists insist Narconon is 85 per cent effective, but it has been alleged the method has been used to convert vulnerable drug addicts to the bizarre sci-fi cult. A toxicology report from Anna Nicole's autopsy is yet to be released.The model-and-actress died on February 8, after being found unconscious in Hollywood's Seminole Hard Rock Hotel and Casino. Methadone and prescription drugs were found in her hotel room.

MORE WARS OVER ANNA NICOLE SMITH

Anna Nicole Smith's mother is battling for custody of her five-month-year granddaughter. Last week, Virgie Arthur lost custody of her daughter's body but now plans to fight the late model's partner Howard K. Stern for custody of Dannielynn. A private hearing will take place in Nassau, in the Bahamas. Arthur and Stern - who is listed as the baby's father on the birth certificate - will also face Larry Birkhead who has failed a paternity claim. Supreme Court Justice Stephen Isaacs has banned Stern from taking Dannielynn away from the Bahamian island until a custody ruling has been made. Isaacs has also placed a gagging order against the attorneys from making anything said in the courtroom public. Last Thursday, custody of Anna Nicole's body was granted to Dannielynn's temporary court-appointed guardian, Richard C. Milstein. Milstein has said the former Playboy playmate should be buried in the Bahamas, next to her son Daniel, who died last September. Arthur had wanted her daughter to be laid to rest near their Texan family home. Despite the court decision being finalised last week, a funeral is still not expected to take place until tomorrow at the earliest, and Anna Nicole's body remains in a Florida morgue. Anna Nicole died on February 8 after being found unconscious in a Florida hotel room.

Probably inspired from the James Brown saga, the Anna Nicole Smith soap opera continues to get more and more sickening. Her body, wanted and used by many men, didn't seem too well even when she was alive, but prospects are much worse now after a much-delayed embalming and, now, burial. Medical examiner Joshua Perper said Smith's body was decomposing faster than expected and should be visible for viewing no later than today, the Miami Herald reported Wednesday. Anna Nicole Smith's estranged mother, Virgie Arthur, filed an emergency request Friday to block her burial in the Bahamas. Her body was previously awarded by Broward County Circuit Judge Larry Seidlin, aka "The Sobbing Judge," to 5-month-old Dannielynn, who is represented by a court-appointed professional guardian.The guardian, attorney Richard Milstein, said that Smith would be buried next to her son, who died in Bahamas last year. However, Milstein gave no time frame."The Broward County medical examiner is ordered to release those remains to Milstein in accordance with Milstein's direction," Judge Seidlin said. "Milstein is directed to consult with Virgie Arthur, Larry Birkhead and Howard K. Stern with respect to disposition of Anna Nicole Smith's remains. But he has final discretion."Seidlin's judicial assistant said the request to block the burial was under review, but the assistant did not know when a ruling would be made, says AP. Attorneys for Virgie Arthur, who instead want Smith buried in Texas, where Arthur lives, are seeking a reversal of Seidlin's decision from the Fourth District Court of Appeal, The Miami Herald reported. The appeals court in West Palm Beach closed at 5 p.m., and Glen Rubin, the Marshal for the court, said no appeal had been filed."We have not received anything," Rubin said to The Miami Herald. Judge Larry Seidlin, a former New York cab driver, was criticized for his apparent unprofessional demeanor during the trial. His wife, Belinda, told ABC that's how Seidlin is -- his emotional outbursts show how much the Smith case affected him. Others say he was just playing along with the Anna Nicole story. "He’s like Judge Judy’s wacky little brother," legal analyst Jefrey Toobin quipped on CNN . The New York Post yesterday called him a "Weepy Wacko," while the Daily News asked, "How Low Can This Judge Go?" and referred to him as "Blubbering Seidlin."Howard K. Stern's attorney, Krista Barth, expressed frustration Friday that Smith's mother waited until the end of the day to file her request. "We could have done this right away. Now it's just delay, delay, delay," she said. What is strange is that Virgie Arthur, Anna Nicole Smith's estranged mother, waited until her daughter's death to "care" for her. However, it doesn't seem a real care, more like an obsession, because it only appears to hamper efforts to finally put Anna to rest. Maybe Arthur feels quilty for not looking after her daughter, maybe before she started off on the wrong tracks which led to her early demise.

"I have suffered for this, I have struggled with this, I have shed tears for your little girl," Broward County Circuit Court Judge (The Nut) Larry Seidlin said to Smith's mother about 15 minutes before he ruled. He said Smith wanted to be buried next to her son Daniel, and that the flame of her beauty was quickly going out. He also urged all the possible fathers of Smith's newborn daughter to get a paternity test. A series of final witnesses were called on Thursday, including the former Playboy Playmate's first husband Billy Smith, the father of Smith's son Daniel, who testified by telephone. Billy Smith, whom Smith married when she was 17, said he wished his son Daniel were buried in Texas, but he didn't have the money to exhume him. Billy Smith added that he wanted Daniel buried next to his mother. Smith's ex-boyfriend Larry Birkhead took the witness stand for the second straight day Thursday in the Florida hearing about who should get custody of Smith's body, testifying more about how he pleaded with Smith to stop her excessive use of prescription medication while she was pregnant.
The hearing recessed Thursday after one attorney almost fainted because of a diabetic reaction to low blood sugar. Birkhead testified that Smith — who was 39 when she died Feb. 8 of as-yet unknown causes — came close to death many times. Birkhead also told the court that Smith's most recent companion, Howard K. Stern, repeatedly interfered in their relationship when the couple's problems mounted in May 2006, ignored Birkhead's concerns about Smith's drug use and harassed Birkhead to deny that he was the father of the baby Smith was carrying. Stern and Birkhead have both claimed paternity of the child, Dannielynn, who is now 5 months old. That matter will be handled by a separate court in California, at least for now. "At times, I took her medicine," Birkhead testified. "I was told by Mr. Stern to give it back to her because she needed it to live. In addition to that, I told her over and over, 'Don't. Something's going to happen to you. Something's going to happen.'" Birkhead's voice broke, and he put his head in his hands. Birkhead, a photographer, also said that after he and Smith went their separate ways, Stern called him repeatedly during jobs he was on to tell him to deny that he was the baby's father, and posted nasty things about him on Smith's Web site. Until then, Birkhead testified he often said "No comment" when asked whether he was the father. "I finally agreed [to deny paternity] just to get him off my back," Birkhead testified. "Then he was saying Anna Nicole wanted me out of her life and said I just wanted my 15 minutes of fame." Birkhead also admitted that he did sell photographs showing Smith and him together to prove they'd been romantically involved. "I told Howard and Anna it wasn't fair for him to be saying that. She said, 'You're not the star. I'm the star,'" said Birkhead. "So I released photos to establish the relationship, and as a result of those photos, I have been compensated and will be compensated."
He said he didn't know off hand how much he was being paid for the pictures, but he said he could get that information to the court. One of Stern's lawyers also showed Birkhead a series of e-mails he allegedly wrote to Smith after their relationship was ending in which he sounded angry and said things like Smith was heading to "the fire pits of Hell." He confirmed that he'd written most of them, but said he didn't remember writing the note that mentioned hell. For a week, attorneys battling for the remains of have fought with one another, fought off the media and fought for a chance to speak. Now their biggest fight is against the clock. Seidlin said he had no time to waste, since the county's chief medical examiner warned again that a decision needed to be made soon before Smith's body became too decomposed for a public viewing. "I got a gun to my head," Seidlin said Wednesday.
Seidlin indicated at the start of testimony Wednesday that he wanted to reach a compromise agreement, but it was unclear what that might be. A recess was called for lunch Thursday after one of Arthur's attorneys, John O'Quinn, apparently had a brief diabetic episode because of low blood sugar, and participants ran over him in alarm. He was given something to drink and Seidlin called for a lunch break. Asked whether he'd object to releasing Smith's body to her mother, Birkhead said on the stand that he wouldn't. After Birkhead stepped down from the stand, Houston police officer Troy Hollier, a former bodyguard of Smith's, testified as a witness for Stern's case. He said Smith had expressed negative feelings about her home state of Texas. The last time he saw Smith, said Hollier, was right after her 20-year-old son Daniel's funeral in the Bahamas. He said he was talking to her by the swimming pool at her Bahamas residence. "She said, 'Troy, if anything should happen to me, I want to be with Daniel,'" Hollier testified.
He also said he'd never seen Smith use prescription medication or any other drugs and he didn't see her taking pills in the period around Daniel's funeral. Daniel died in September of a lethal drug combination. The judge got angry at Hollier's claims that though he knew Smith well, he'd never seen her use drugs — since everyone else had testified that she had been on medication — and asked that he step down from the witness stand. "Something doesn't add up here," Seidlin said. "I'm not buying it." On Wednesday, Arthur testified that her last conversation with her daughter about her burial came more than 10 years ago, when Smith said she wanted to be interred near her idol Marilyn Monroe, whose body is in a Los Angeles crypt. The admission could hurt the woman's fight to have the former pinup laid to rest in her native Texas. "Wherever the stars are buried, that's where she wanted to be buried," Arthur said. Birkhead testified he had had a similar conversation with his ex-girlfriend in recent years. Even Stern has acknowledged the former Playboy model had hoped to be buried near Monroe, though he said she settled on a Bahamian site after her son died last year and the details of the California plot could not be worked out. Stern six months before she died.The film - which emerged yesterday - shows the then eight months pregnant model, in what appears to be a drugged state, with clown make-up on her face talking to a doll in a pram as though it is a real baby. Stern asks repeatedly "is this a mushroom trip?", before adding "I'm kidding". As Anna Nicole becomes less and less lucid he says: "This footage is worth money."It was also revealed yesterday that Bahamian Immigration Minister Shane Gibson has resigned. Shortly after the former Playboy model died pictures were released of her and Gibson lying fully clothed in bed and embracing. One shot shows Anna Nicole presenting Gibson with a Rolex watch. She moved to the Bahamas last year and was granted residency status, before giving birth to daughter Dannielynn. It was claimed Gibson had fast tracked Anna Nicole's residency, meaning Dannielynn was a Bahamian citizen and could escape from the paternity battle raging in the US.The model-and-actress died on February 8 after being found unconscious in a hotel room. Her will left everything to her son Daniel, who died in September last year.

JUDGE APPROVES EMBALMING AND ANNA NICOLE SMITH'S WILL IS READ

A judge approved the embalming of Anna Nicole Smith's remains Friday as he tried to broker an agreement among the three people fighting over the former Playboy Playmate's body.Lengthy legal fights still loomed over where she will be buried and who will get custody of her infant daughter. Stern's attorneys say Smith bought a plot in the Bahamas, next to the plot where her son, Daniel, is buried. He died in September, three days after Smith's baby daughter, Dannielynn, was born at a Bahamas hospital.

BICKERING LAWYERS

Besides the lawyers for Stern and Arthur, there are attorneys for Smith, daughter Dannielynn, and Smith's former lover, Larry Birkhead, who is seeking a paternity test to prove he is Dannielynn's father. The lawyers have frequently traded barbs. "The woman sitting across from me was estranged from her daughter. I have people who loved her," sniffed Barth, attorney for Stern, on Thursday. "She stands here today to take her to Texas and put her in the ground all alone. It's sad and it's sick." Retorted Arthur's lawyer, Stephen Tunstall: "Counsel is trying to trash my client in some kind of emotional appeal. My client is her mother. She wants to take her back to Texas to be buried with the rest of the family. She has the right." And so it went, all day Thursday for half a day on Friday and, from the looks of things, for many more days to come. The judge worked hard to keep things on track. "We're trying to balance the rights and respect of the body with the legal issues," Seidlin said. "When we bury her, I want it to be forever," The judge has appointed a guardian, Miami attorney Richard Milstein, to protect the interests of Smith's infant daughter, Dannielynn. He also appointed Kelley, a Fort Lauderdale lawyer, to sort through the competing interests and advise him.
Witnesses, including people close to Smith, are expected to testify Tuesday.

SO MANY FATHERS

Birkhead and Stern each claim to be the father of Smith's nearly 6-month-old daughter, Dannielynn. Stern's name is on the birth certificate. Smith's former bodyguard, Alexander Denk, told CNN's Larry King that he, too, could be Dannielynn's father, saying he and Smith had an off-and-on relationship for years. Denk is the fourth person to claim he could be the child's father. Zsa Zsa Gabor's husband, Frederic von Anhalt, has said he and Smith had a decade-long affair and that he could have fathered the child. He filed court papers seeking a paternity test on Thursday. Seidlin repeated several times that the most important issue to his court was the welfare of the baby. He also stressed the importance of maintaining dignity. "We want to preserve the beauty and model figure of Ms. Smith," he said. "Beauty was important to her, as you all have indicated to me, and we want her to look beautiful when she is placed in her final resting place." Smith, 39, died February 8 after she was found unconscious in her room at the Seminole Hard Rock Hotel & Casino near Hollywood, Florida.
Among the issues the attorneys wrangled over was whether Stern had legal standing to determine a burial place, or even to take part in the proceedings; and who was Smith's next-of-kin under Florida law. Tunstall, the attorney for Smith's mother, argued that Dannielynn did not qualify because a child must be over 18 to be legally considered next-of-kin. The release of Smith's body -- and even the embalming process -- was delayed because attorneys for Birkhead wanted a DNA sample for a paternity test. The judge ordered an additional sample be taken.

Charlize Theron has been tipped to play Anna Nicole Smith in a film about her life.The actress is movie bosses' first choice to star as the Playboy Playmate who married an 89-year-old oil billionaire and died aged just 39 last week. A source revealed: "You couldn't make up a life story like Anna's. Studios are falling over themselves to pay tribute to an incredible woman. Anna Nicole Smith tried to commit suicide at least twice after she gave birth to Dannielynn last September, it has been claimed. In legal documents written by the late Playboy Playmate's former nanny, Quethlie Alexis, it is alleged Anna Nicole - real name Vickie Marshall -wanted to end her life. Alexis stated: "Ms Marshall attempted to commit suicide on two separate occasions."On the first occasion, she drank in my presence an entire bottle of what I believed to be a sleeping aid."When she awoke from the resulting 48-hour coma, she said, 'I wanted to die. I meant to kill myself.'"She also tried to drown herself in her swimming pool. Howard K. Stern rescued her. I heard him say to her, 'If anything happens to you, I would go to jail.' "The sworn affidavit, written in the Bahamas on December 4, 2006, also reveals Anna Nicole was obsessed with keeping her baby slim, because "she wanted her to be 'sexy' ". Alexis claimed: "Ms. Marshall was obsessed with making sure that her baby was 'sexy'. Ms. Marshall knew that the correct amount of baby food was 3 ounces every 3 hours. Howard K. Stern has returned to the Bahamas and vows that Anna Nicole Smith's estranged mother will never see her grandchild, Dannielynn Hope. Smith's mother, Virgie Arthur, reportedly flew to the Bahamas and tried to gain access to the child while Stern, listed as the father on the infant's birth certificate, was grieving over Smith's unexpected death in Hollywood, Fla., the New York Post reported. Stern was reunited with his child in front of cameras from "Entertainment Tonight" and "The Insider." ( How much did they pay him this time? ) "This is the only piece of Anna I have left," said Stern as he scooped up Dannielynn. "I wouldn't be here now, but I had to get back to Dannielynn. I know Anna loved her more then anything in the world," he said tearfully. But Stern's sadness didn't last for long; it quickly turned to anger when the subject of Arthur came up. "Anna despised that woman. As long as I have breath in my body, that woman will not see Dannielynn," Stern raged. Meanwhile the mansion that Anna Nicole Smith lived in with her 'FAKE' husband Howard K. Stern is making headlines. Stern returned to the home yesterday and decided to have the locks changed for the second time since Sunday. A dispute has risen about who the real owner of the estate may be. Smith claimed that the residence was given to her by former boyfriend G. Ben Thompson. It appears that Thompson denies these allegations.

ANNA NICOLE'S DEATH ADDS MORE MYSTERY

Several people close to Anna Nicole Smith were quick to speculate after her death that drugs were to blame. The medical examiner who performed an autopsy on her body, though, said it could take weeks to determine a cause of death. Dr. Joshua Perper, the Broward County medical examiner who did the autopsy, said Friday that no illegal drugs were discovered in the 39-year-old Smith's room at the Seminole Hard Rock Hotel and Casino in Hollywood after she collapsed there on Thursday. Perper said there were prescription drugs in the room, but would not identify which. He said it could take three to five weeks to conclude his investigation, which will include toxicology tests. CNN quoted an unidentified law enforcement source as saying there were large amounts of prescription drugs, including Valium and antibiotics, as well as over-the-counter cold and flu medication taken from Smith's room. But Perper said the autopsy found no immediate evidence, either in Smith's stomach or her bloodstream, that she had taken large amounts of prescription medication. Still, officials "do not exclude any kind of contribution of medication to the death,'' he added. Michael Scott, a former attorney for Smith in the Bahamas, and Smith's mother, Vergie Arthur, have both said they think drugs played a part in Smith's death. "I think she had too many drugs, just like Danny,'' Arthur told ABC's "Good Morning America'' on Friday. "I tried to warn her about drugs and the people that she hung around with. She didn't listen.'' There was no indication Smith was the victim of a crime, Seminole Police Chief Charlie Tiger said, and Perper said the autopsy was able to exclude any kind of physical injury, such as blows to the body or asphyxiation. Authorities said they planned to interview a nurse and others and examine medical records before settling on a cause of death. Meanwhile, a Los Angeles judge on Friday ordered that the Smith's body be preserved for at least 10 days for a possible DNA test related to a paternity dispute over her daughter, Dannielynn. The judge refused to order the DNA test be carried out immediately. The ruling could interfere with plans for a funeral. Normally, there is no need for DNA testing on the mother in a paternity case. But one of the men claiming to be the baby's father asked for genetic material from Smith to guard against a possible baby switch. Attorney Howard K. Stern, Smith's most recent companion, and Larry Birkhead, a former boyfriend have both claimed to be Dannielynn's father. In yet another bizarre twist, a third man - the husband of actress Zsa Zsa Gabor, Prince Frederic von Anhalt _ stepped forward Friday to claim he had had an affair with Smith and may be the baby's father. The paternity decision could determine the child's inheritance. Smith had been waging a yearslong court battle at her death over the estate of her late husband, J. Howard Marshall II, who died in 1995 at age 90. A federal court in California awarded Smith US $474 million euro 364 million), but that was later overturned. AUTOPSY FINDINGS ON ANNA NICOLE SMITH

More tests will be necessary to determine the cause of Anna Nicole Smith 's death, but no illegal drugs were found in her hotel room, officials said Friday. It's possible Smith's died of natural causes, because of some medication or from a combination of reasons, said Dr. Joshua Perper, the chief medical examiner for Broward County, who performed the autopsy. Smith apparently had been sick for several days with some kind of stomach flu, Perper said. Seminole Police Chief Charlie Tiger said investigators "found no illegal drugs, only prescription medicines" in Smith's hotel room at the Seminole Hard Rock Hotel and Casino in Hollywood. Nothing unusual was observed on hotel surveillance tapes, and there was no evidence to suggest a crime occurred, he said. On Thursday, a private nurse found Smith unconscious in her room and called 911, officials said. A bodyguard performed CPR, Tiger said, but Smith was declared dead at a hospital. The autopsy was performed Friday on Smith, whose mother blamed drugs for the former Playboy playmate's sudden death that ended an extraordinary tabloid life. In another bizarre twist to the case, the husband of actress Zsa Zsa Gabor, Prince Frederick von Anhalt, claimed that he might be the father of Smith's infant daughter. Two other men are already waging a paternity battle over the little girl, who stands to inherit Smith's estate. Von Anhalt, 59, told The Associated Press he and Smith had been having an affair since the 1990s. "She wanted to be a princess," he said. "I think she had too many drugs, just like Danny (Smith's late son)," Smith's mother, Vergie Arthur, told ABC's "Good Morning America" on Friday. "I tried to warn her about drugs and the people that she hung around with. She didn't listen." "She was too drugged up," Arthur said. "By the last interview I saw of her, she was so wasted." Smith's attorney, Ron Rale, said the one-time reality TV star had been ill for several days with a fever and was still depressed over the death five months ago of her 20-year-old son from what a private medical examiner determined was a combination of methadone and two anti-depressants. Late Thursday, sheriff's deputies carried out at least eight brown paper bags sealed with red evidence tape from Smith's hotel room. Several detectives are reviewing the hotel surveillance tapes to see if they might provide a clue to what happened, Deputy Police Chief Michael Browne said Friday. He said they had interviewed everyone connected to the death and no one was under suspicion. "Nothing about this death seems suspicious. We're not treating it that way," Browne said. "We're being very thorough. We're going to look at everything." If Smith died of natural causes, the findings will likely be announced quickly, but definitive results could take weeks, said Dr. Joshua Perper, who was performing the autopsy. "I am not a prophet, and I cannot tell you before the autopsy what I am going to find," he said. Smith's son's death in the Bahamas on Sept. 10 came just a few days after she gave birth to a daughter, Dannielynn, whose custody remains in dispute. The birth certificate lists Dannielynn's father as attorney Howard K. Stern, Smith's most recent companion, who Rale said was with Smith at the hotel and was too choked up to talk when he called Rale with the news. Smith's ex-boyfriend Larry Birkhead is waging a legal challenge, saying he is the father. At a hearing Friday in Los Angeles, a judge declined Birkhead's attorney's request to order an immediate DNA sample be taken from Smith's body. The judge ordered the body be retained, though, until a hearing on Feb. 20, attorney Debra Opri said. Opri said the DNA is needed to connect Smith with Dannielynn "so that no one can switch the babies." She also asked the judge to take jurisdiction over the child until her paternity is established. "Nothing was granted. Nothing was denied," she said. Rale, Smith's attorney, said it was "despicable that we would have an emergency notice and appear right now." Gabor's husband, von Anhalt, said Friday that he would file a lawsuit if Dannielynn is turned over to Stern or Birkhead. He said he and Smith started their long affair after she approached him and Gabor at the Plaza Hotel in New York while she was still married to Marshall. "If you go back from September, she wasn't with one of those guys, she was with me," von Anhalt said. The baby was being cared for in the Bahamas by the mother of Shane Gibson, the Bahamian immigration minister who is a close friend of Smith's, People magazine reported on its Web site, citing unidentified sources. A visibly shaken Gibson declined comment as he was leaving his office Thursday night, and he has not responded to several message left by the AP seeking comment. Through the '90s and into the 21st century, Smith was famous for being famous, a pop-culture punchline because of her up-and-down weight, her Marilyn Monroe looks, her exaggerated curves, her little-girl voice, her ditzy-blonde persona and her over-the-top revealing outfits. Rale said he had talked to her on Tuesday or Wednesday, and she had flu symptoms and a fever and was still grieving over her son. He dismissed claims her death was related to drugs as "a bunch of nonsense." "Poor Anna Nicole," he said. "She's been the underdog. She's been besieged ... and she's been trying her best and nobody should have to endure what she's endured." The Texas-born Smith was a topless dancer at a strip club before she made the cover of Playboy magazine in 1992. She became Playboy's playmate of the year in 1993. She was also signed to a contract with Guess jeans, appearing in TV commercials, billboards and magazine ads. In 1994, she married 89-year-old oil tycoon J. Howard Marshall II, owner of Great Northern Oil Co. After his death the following year, she engaged in a protracted legal fight with her former stepson, E. Anna Nicole Smith, the former Playboy playmate whose bizarre life careened from marrying an octogenarian billionaire to the untimely death of her son, died Thursday after collapsing at a South Florida hotel, one of her lawyers said. Smith, 39, collapsed and was unresponsive while staying at the Seminole Hard Rock Cafe Hotel and Casino, said the attorney, Ron Rale. She was rushed to a hospital. "She checked in Monday at 8 p.m. as a guest. She was due to check out tomorrow," said Danielle Giordaano, a spokeswoman for the hotel. Smith had been a tabloid staple even before she became Playboy's playmate of the year in 1993. Readers were fascinated by her bombshell good looks, her marriage to an elderly billionaire and subsequent court fight over his estate, her weight fluctuations, and last year, the sudden death of her 20-year-old son, Daniel Smith. A former topless dancer, she made her name squeezing into Guess jeans. She resembled the late actress Marilyn Monroe, a similarity played up in her Guess magazine ads, billboards and department store displays. In 1994, she married 89-year-old oil tycoon J. Howard Marshall II, the head of oil-based Koch Industries, which is part of a family fortune worth at least $400 million. He died in 1995, setting off a feud with her former stepson, E. Pierce Marshall, over whether she had a right to his estate. A federal court in California awarded Smith $474 million in a complicated legal twist that began after she declared bankruptcy. That was later overturned. But in May, the U.S. Supreme Court revived her case, ruling that she deserved another day in court in her battle with her former stepson. The justices said only that federal courts in California could deal with her case despite a Texas state court ruling that Marshall was the sole heir to the estate. Then, the stepson died June 20 at age 67. But the family said the court fight would continue. Daniel Smith died Sept. 10 in his mother's hospital room in the Bahamas, just days after she gave birth to a daughter. An American medical examiner hired by the family, Cyril Wecht, said he had methadone and two antidepressants in his system when he died. Low levels of the three drugs interacted to cause an accidental death, Wecht said. Meanwhile, the paternity of her now 5-month-old daughter remained a matter of dispute. She was born Vickie Lynn Hogan on Nov. 28, 1967, in Houston, one of six children of Donald Eugene and Virgie Hart Hogan. She married Bill Smith in 1985, giving birth to Daniel before divorcing two years later.

ANNA NICOLE SMITH FURIOUS AT MOM

Anna Nicole Smith has launched a furious TV torrent of abuse on her estranged mother after learning she visited the grave of Smith's late son in the Bahamas. The actress/model flew into a rage when she saw photographs of Virgie Arthur kneeling at her grandson Daniel's grave and kissing the ground where he's buried. Smith refused to invite members of her estranged family to the funeral service last year and cannot believe her mother made the trip to see Daniel's final resting place. In a taped TV interview, which will air on Monday, an angry Anna Nicole hisses, "I can't believe she had the nerve to come up here on my son's 21st birthday and lay her fat self on my son's grave." Arthur enraged her daughter after Daniel's death last September by appearing on TV news shows insisting the 20-year-old was murdered and pouring scorn on Smith's plans to wed her attorney Howard K. Stern. In one interview last November, Smith stated, "She (Arthur) hasn't seen my son since he was probably about 5 years old; she doesn't know him, she doesn't know me. "For her to go out there and make these ridiculous statements about me killing my son or Howard killing my son, who does she think she is? "When I saw her on CNN and I saw how evil she was and how evil she looked ... bring it on, Mom, Mommie Dearest, bring it on."
